Conclusion of contract
By placing the products in the online store, we submit a binding offer to conclude a contract for these items. The contract is concluded when you accept the offer for the products contained in the shopping cart by clicking on the order button. After submitting your order, you will receive a confirmation by e-mail.
The condition for the effective conclusion of a contract is always that the order process is completed when the order is sent.
If you register by contact form, email or telephone, this constitutes an offer to conclude a contract. The confirmation sent to you is the declaration of acceptance of this offer.
By placing an order or registering, you acknowledge the validity of the conditions of participation and GTC.
Registrations will be considered in the order in which they are received.

Payment agreement
Payment of the seminar fee is due when the order confirmation or registration confirmation is sent. In the case of a down payment and/or payment in installments agreed separately in writing, the remaining amount is due at the latest two weeks before the start of the seminar or in accordance with the individual installment payment agreement.
With the payment you accept the underlying announcement (usually, but not exclusively, an info pack, a flyer, an advertisement, an event or article description) as part of the contract.
The participation fee is non-refundable.

Withdrawal, cancellation costs
Cancellations are only possible in writing (by post, e-mail). It is possible to send a substitute participant. If the cancellation conditions and cancellation costs are not defined (differently) in the information material, the following cancellation fees apply in principle:

a) In-person events

  • Cancellation up to 4 weeks before the start of the event: free of charge
  • Cancellation within 4 weeks before the start of the event: 25% of the participation fee
  • Cancellation within 14 days before the start of the event: 50% of the participation fee
  • Cancellation from 1 week before the start of the event or no-show: 100 % of the participation fee

b) Online events

  • Cancellation up to 14 days before the start of the event: free of charge
  • Cancellation within 14 days before the start of the event: 50% of the participation fee. This also applies if the registered participant does not log in.
  • Cancellation from 1 week before the start of the event or no-show: 100 % of the participation fee

If documents, specialist books (e-books, pdfs) have already been delivered before the free cancellation period has expired, the provider is entitled to charge the costs for these on a pro rata basis.
The date of receipt of the post/e-mail shall be deemed to be the date of compliance with the cancellation deadlines.

Copyright
The documents (scripts, graphical representations, podcasts, videos, recordings, etc.) issued as part of a seminar or online course or made available for download via the Internet are protected by copyright. These rights belong exclusively to SunGalaa and its licensors. The participant does not receive any ownership or exploitation rights to the content provided. They are therefore intended exclusively for personal use. All rights, including those of translation, reprinting and reproduction of the seminar documents or parts thereof are reserved. No part of the seminar documentation may be reproduced in any form or processed, copied, distributed or used for public reproduction, in particular using electronic systems, without the prior written consent of the provider. You indemnify the provider against all third-party claims in the event of infringement.
The trademarks and logos listed on the documents are protected under the Trademark Act. They may not be removed or altered.

Cancellation of seminars, subject to change
The provider reserves the right to cancel the event if the minimum number of participants is not reached at least 7 days before the planned date of the event or for other important reasons for which the provider is not responsible (e.g. sudden illness of the trainers and speakers, force majeure). You will be informed of this at short notice and in writing.
Participation fees already paid will be refunded if a seminar is canceled. Further liability and compensation claims that do not relate to injury to life, limb or health are excluded, except in cases of intent or gross negligence. No liability is accepted for indirect damages, in particular loss of profit or third-party claims.

The provider is entitled to make any necessary changes or deviations to the content, methodology and organization before or during the event, provided that these do not significantly change the benefits of the announced event for you. The Provider is entitled to replace the named speakers with other qualified speakers with regard to the seminar topic if there is an important reason such as illness or accident. A claim for damages for this is excluded.

If the cancelled event is repeated and you would like to postpone your participation to the new date, we offer to rebook the already paid participation fee to the new date free of charge.

Liability of the provider
In the event of cancellation of a seminar due to illness of the speaker, insufficient number of participants, cancellations for which the provider is not responsible or force majeure, there is no entitlement to the seminar being held. We accept no liability whatsoever for items taken into the workshops and training events or for other direct damage and costs, including loss of earnings, loss of profit or third-party claims, loss of data, travel costs, consequential damage and financial loss of any kind. This applies in particular to the theft of valuables from changing rooms, seminar rooms, etc. Forgotten items will be left in the respective seminar room and can be collected there if necessary. They will not be redirected.

Your liability as a participant
You are fully responsible for yourself and your actions inside and outside the seminar. You are responsible for any damage caused and indemnify the course leaders and the host of the venue against all liability claims. We would like to point out that all seminar participants are responsible for the safe storage of their personal belongings and valuables.

It is also expressly pointed out that our seminars and counseling/coaching sessions are not a substitute for medical, therapeutic or psychiatric treatment. Anyone undergoing medical treatment and/or therapy must clarify with us and their treating doctor/therapist in good time whether they can take part in the seminar.

Data protection
Customer data is stored and processed in strict compliance with the German Federal Data Protection Act. Customer data is stored for processing, billing and advertising purposes in the form of names, telecommunications data and addresses of the service/business location. It is understood that photos of you taken at the events may be used. You can object to the use of your data for advertising purposes. Please let us know in writing.

Live courses may be recorded in order to make the content available to participants again afterwards. Recording ensures that participants do not miss out on individual content that is relevant to them, even in the event of a scheduling conflict. Participants should also be given the opportunity to review courses that have already taken place as required.

In the case of recording, files of all video, audio and presentation recordings are created. The chat is also saved. If you do not want others to be able to identify you, you have the following options:

  • Switch off the video function.

  • Mute your microphone and only use the chat function.

  • If you do not want your name to be visible in the chat area, the chat cannot be used.

Recordings are usually made available for streaming. When booking a (paid or free) course, there is no entitlement to a recording of the event. For technical reasons, it may happen that such recordings cannot be made if the server load is very high or, in consultation with the lecturers, no recording should be made. For the avoidance of doubt, there is therefore no entitlement to a partial or full refund of the course fee if no recording can be made available. We therefore always recommend live participation in webinars.
The recording takes place, subject to the express consent of the participants, on the basis of our legitimate interests pursuant to Art. 6 para. 1 lit. f) GDPR in order to make them available to the participants for the above-mentioned purposes. It is not possible to withdraw consent for the past.

Your obligations to participate in online seminars
Technical conditions must be met in order to participate (e.g. stable internet connection, current browser version, sufficient exposure, correct camera position, etc.). You are responsible for checking and ensuring that the technical requirements are met. A possible failure of your technical requirements, possibly also during the web seminar, does not release you from the contractual payment obligation.
Before the event, you will receive access data to the e-mail address you provided when registering. You are obliged to handle the access data with care, not to pass them on to unauthorized third parties and to protect them from access.

Terms of use
Participation in the online seminar is only permitted for persons named and registered. You undertake not to make any visual, acoustic or other recordings of the online seminar and to ensure that no other persons are present in the respective rooms during the online seminar.
The participation of several persons on one end device or in one room or the transmission of an online event to a conference room, group room, training room or similar is only permitted if all persons present there are registered as participants for this event. Any violations of this user agreement will result in the immediate loss of the right to participate in the event for the natural and legal persons involved. The right to make further claims, such as subsequent billing of persons who have not registered, is reserved.

Consultations, coaching
These GTC also apply here. In the case of coaching sessions and consultations, a legally effective contractual relationship is also established if an appointment is made verbally or by telephone. By placing an order, you accept these conditions.
The previously agreed fee is to be paid by bank transfer within 10 days of invoicing.
It is possible to cancel the coaching or consultation free of charge up to 48 hours before the appointment. If the appointment is canceled at a later date or does not take place, the agreed amount is due in full.
All documents and information received will be treated confidentially.

Cancellation policy – Right of withdrawal
You can declare the revocation of your contract declaration in text form (e.g. letter, e-mail). The revocation does not have to contain any reasons. The withdrawal period begins on the day of registration, its duration is 14 days.
The revocation is to be sent to the above address.

Consequences of revocation
In the event of an effective revocation, the services received by both parties must be returned. All refund obligations must be met within 30 days of the revocation notice.

Final provisions
The law of the Federal Republic of Germany applies exclusively to these GTC and their implementation. The Terms and Conditions of Participation shall remain binding in their remaining parts even if individual provisions are legally invalid. Ineffective terms and conditions shall be replaced by terms and conditions that come closest to the economic purpose of the ineffective ones. Deviating agreements are only effective if they are agreed in writing. In commercial transactions, the place of performance and jurisdiction shall be the registered office of the company in Karlsruhe. Should individual provisions of these General Terms and Conditions be invalid, this shall not affect the validity of the other provisions.

These General Terms and Conditions shall apply from April 1, 2024; previous General Terms and Conditions hereby cease to apply.
